Namun, masih banyak tantangan yang harus dihadapi Indonesia untuk mulai beralih ke energi terbarukan, salah satunya adalah tentang regulasi energi terbarukan.

Dari sisi pemanfaatan energi, dunia masih sangat bergantung terhadap energi tak terbarukan alias energi fosil. Banyaknya penggunaan energi fosil menimbulkan banyak dampak negatif, seperti meningkatnya polusi udara, meningkatnya emisi gas rumah kaca, dan lingkungan juga menjadi rusak akibat limbah yang dihasilkan. Oleh karena itu, pengembangan energi terbarukan sangat penting untuk ditingkatkan dan terus dikembangkan akhir-akhir ini, khususnya bagi Indonesia.

Selain itu, untuk mencapai target pengurangan emisi di tahun 2030 sebanyak 29%, dibutuhkan transisi yang signifikan dari konsumsi dan produksi energi mineral ke energi terbarukan. Berdasarkan Rencana Umum Energi Nasional (RUEN), negara menargetkan penggunaan energi terbarukan secara nasional sebesar 23% di tahun 2025 dan 31% di tahun 2050.

Meskipun transisi ke energi terbarukan masih dirasa cukup lambat di Indonesia, namun Indonesia sendiri telah memiliki beberapa pilihan energi terbarukan yang sedang dikembangkan dan akan terus dimaksimalkan sebagai alternatif sumber energi yang Sobat EBT Heroes gunakan di masa depan. Energi terbarukan merupakan sumber energi yang dapat dimanfaatkan secara bebas, dapat diperbaharui secara terus menerus, dan ketersediaannya di alam cukup melimpah. Selain itu, energi terbarukan juga ramah lingkungan, mandiri energi, mampu mendorong perekonomian, bebas dari fluktuasi harga dan biaya jangka panjangnya lebih murah daripada energi fosil. Beberapa energi terbarukan juga mudah diterapkan di daerah-daerah terpencil sehingga produksinya bisa dihasilkan diberbagai tempat. Selain itu, perawatan energi terbarukan relatif lebih mudah dan murah.

Namun, pengembangan energi terbarukan di Indonesia masih penuh tantangan. Terdapat berbagai kendala, seperti harga jual beli tenaga listrik dari energi terbarukan yang kurang menarik di mata pengembang karena jauh lebih mahal dibandingkan harga sumber energi fosil yang disubsidi negara, kebijakan yang mudah sekali berubah hingga membuat pengembangannya lamban, serta sumber daya yang terkendala. Berbagai kendala tersebut telah dialami oleh pelaku usaha pengembang PLTP di Indonesia.

Direktur Utama PT Geo Dipa Energi (Persero), Riki F. Ibrahim, juga mengatakan bahwa “Belum lagi masalah transparansi dan jangka waktu penerbitan perizinan yang dapat memengaruhi perekonomian proyek panas bumi. Selain itu, kami juga dihadapkan masalah sosial di area proyek, seperti penolakan dari kelompok masyarakat tertentu”. Di samping itu, masih ada masalah operasi sistem kelistrikan yang belum mendukung sifat intermitensi energi terbarukan, seperti pada PLTS atau PLTB. Menurut Kepala Pusat Studi Energi Universitas Gadjah Mada, Deendarlianto, untuk mengoptimalkan sumber daya energi terbarukan di Indonesia memang memerlukan perhatian penuh yang konsisten dari pemerintah untuk mencapai target bauran energi nasional.

Ketua Umum Masyarakat Energi Terbarukan Indonesia (METI), Surya Darma, mengatakan bahwa selama ini salah satu hambatan dalam pengembangan serta pemanfaatan energi terbarukan di Indonesia adalah regulasi yang seringkali berubah atau biasa disebutnya sebagai up and down. Regulasi up and down menyebabkan para investor yang ingin berinvestasi tidak memiliki kepastian dalam aspek legalitas. “Karena itu lah kenapa, salah satu yang saya kira harus diapresiasi adalah akan terbit Peraturan Presiden (Perpres). Kita berharap Perpres tidak mudah berubah, sebagaimana peraturan menteri yang terdahulu. Itu yang kami sebut up and down,” ujar Surya.

Direktur Aneka Energi Baru dan Terbarukan Kementerian Energi dan Sumber Daya Mineral, Harris Yahya, menambahkan bahwa regulasi yang seringkali berubah adalah regulasi di tingkat menteri. “Kalau regulasi level undang-undang atau Perpres itu belum berubah, tapi yang berkaitan dengan Peraturan Menteri (Permen) memang ada beberapa kali perubahan. Yang kita pakai Permen ESDM Nomor 50 Tahun 2017 yang sudah beberapa kali direvisi untuk akomodir pengembangan Energi Baru Terbarukan (EBT).” ujar Harris. Permasalahan regulasi up and down memang sudah menjadi catatan pemerintah. Oleh sebab itu, aturan yang mengatur harga EBT sekarang akan diangkat menjadi Perpres. “Harapannya kalau menjadi Perpres, semua akan melaksanakan sesuai yang diatur di dalam Perpres.” Sehingga dengan adanya hal tersebut, regulasi akan lebih jelas dan terarah.

Undang-Undang untuk Regulasi Energi Terbarukan

Menurut Undang-Undang Republik Indonesia Nomor 30 Tahun 2007 Tentang Energi, Pasal 1 ayat 6, sumber energi terbarukan artinya sumber energi yang dihasilkan dari sumber daya energi yang berkelanjutan jika dikelola dengan baik, antara lain panas bumi, angin, bioenergi, sinar matahari, aliran dan terjunan air, serta gerakan dan perbedaan suhu lapisan laut.

Adanya Undang-Undang tersebut, diharapkan dapat terintegrasi dalam sebuah regulasi yang memayungi peran energi terbarukan yang saat ini diuraikan dalam peraturan-peraturan yang sudah ada. Selain itu, dengan adanya Undang-Undang yang fokus pada energi terbarukan, diharapkan dapat mengatasi kesenjangan antara kebijakan pemerintah dan regulasi yang ada di Indonesia, serta mendukung pencapaian energi terbarukan dalam target bauran energi nasional. Harapannya Undang-Undang ini bisa menjadi payung regulasi untuk mendukung keberhasilan implementasi energi terbarukan.
